The 1934 Act remains the primary law in telecommunications today. In fact, the 1996 Act simply updates, not replaces, the 1934 Act, and its titles exist for convenience of the 1996 Act. They do not, however, replace the overriding industry identification titles of the 1934 Act. For example, Title I of the 1934 Act covers General Provisions, while Title II addresses the common carrier industry, including the telephone and telegraph companies and their services. Title III contains the laws affecting the radio or wireless industry, while Titles IV and V address “Procedures and Administrative Provisions” and “Penal Provisions—Forfeitures,” respectively. In the 1940s, Title VI was added to cover cable television issues and Title VII to address “Miscellaneous Provisions.” These titles provide the industry labels used today. For example, many discussions and documents in telecommunications refer to services and products as being Title II (Telephone/Telegraph), Title III (Wireless), and Title VI (Cable) elements. These titles in the 1934 Act should not, however, be confused with the titles of the 1996 Act, discussed in more detail in Chapter 3 .

The study of language can be important in helping us to make and clarify such distinctions, but beyond this information-providing role, it has nothing to say about which, if any, of these candidates constitutes a statute's contribution to the law. The communication theory therefore lacks the resources to say what any statute's contribution is. Ultimately, trying to understand legislation on the model of communication is misguided because legislation and legislative systems have purposes that have no parallel in the case of communication, and that may be better served if a statute's contribution to the content of the law is not constituted by what is communicated by the legislature.
